Pike Bay Township September 11, 2018 Regular Monthly Meeting / 7PM Milt Lee called the meeting to Order at 7:05 followed by the Pledge of Allegiance. Present: Milt Lee, Jason Ball, Linda Barsness, Richard Baird, Arvin Gieseke, Mary Almendinger Absent: Tony South Guests: Zeb Hemsworth, Tim Norton Agenda: Motion to approve agenda by Jason Ball, Linda Barsness second, carried. Public Comment: none Minutes and Records: Motion to approve minutes of Regular Monthly Meeting held August 13, 2018 by Linda Barsness, Milt Lee second, carried. Old Business: The road vacation to LLBO has been turned over to Andy Shaw, our attorney. A public meeting will be scheduled once the Road Agreement has been signed by LLBO. Joseph Fowler indicated that LLBO legal department approved the initial draft to move forward. Motion to approve initial draft by Jason Ball, Milt Lee second, carried. Update from Troy Gilchrist, Attorney at Law for Kennedy & Graven. Sarah Sonsalla will be handling the case regarding the interest and penalties for unpaid withholding taxes and failure to file reports from 2011thru 2017. She has experience dealing with this type of issue all the way to Federal Tax Court. Power of attorney forms need to be signed on behalf of the Township and returned to her so she can submit to IRS and Department of Revenue. She has contact persons at both entities and will take steps towards a settlement. Per Minnesota Statutes Section 609.456, whenever a public employee or public officer of a political subdivision discovers evidence of theft, embezzlement, unlawful use of public funds or property, or misuse of public funds by a person authorized to expend public funds, the employee or officer shall promptly report to law enforcement and shall promptly report in writing to the State Auditor a detailed description of the alleged incident. Motion to give Power of Attorney to Sarah Sonsalla and to have her draft a letter to the State Auditor by Milt Lee, Richard Baird second, carried. New Business: District 11 Meeting was attended by Tony South and Richard Baird. Motion to approve 3.2 liquor license for Cass Lake Lodge by Milt Lee, Linda Barsness second, Jason Ball abstained, passed and carried. Motion to approve liquor license for Birch Villa Lodge by Jason Ball, Milt Lee second, passed and carried. Motion to approve purchase of a leaf blower for use on newly sealed parking lot and on garage areas by Linda Barsess, Milt Lee second, carried. A battery type not to exceed $300.00 was agreed upon. Motion to approve raise for custodian, Nina Burnett was tabled until Reorganization Meeting in January. She has been employed for 1 ½ years and has proven to be very dependable and willing to tackle all projects. Correspondence: Letter of public commendation for Zeb Hemsworth from Dr. Matthew J. Stiehm. Board agreed to have Cass Lake Times publish it. Senior Official Workshop for All-Hazards Preparedness at the Sourcewell Headquarters in Staples on October 11, 2018 from 9 am to 4 pm. Deadline to register is October 4th. The workshop is free and lunch will be provided. Cass County Association of Townships Fall Conference is October 4th, 2018 with registration at 7:30 at the Bear Pause Theater, Hackensack, MN. Financial Report: September disbursements for Checks #14745 thru #14791 and 3 electronic transfers totaling $22,972.30. These figures include the end of month payroll for August, and mid August for the Police officers, and the bills that were received through 9/11/2018. Motion to approve disbursements as presented by Jason Ball, Milt Lee second, carried. Motion to approve reimbursement for travel request to TZD training in Mankato for Zeb Hemsworth by Linda Barsness, Jason Ball second, carried. Motion to approve hire of Tim Norton, part time, contingent upon completing background investigation and POST requirements by Milt Lee, Linda Barsness second, carried. Road Report: Mowing top cut on Tom’s Resort Road, Angler’s Beach Road, Doppleganger and South 2nd Street. Golf Course Road and Resort loop is done. New curve signs were installed on Richard’s Road and Russell Road. Storlie Construction filled a sink hole on Sah-Ka-Tay Loop Road and made a repair on Newstrand Road. Crack sealing on South Frontage Road has not started yet. Possible gopher problem along Sah-Ka-Tay Loop Road. Fire Department Meeting Report: none Clerk Report: Worked on election including posting, publishing, election judge scheduling and trainings. Worked with attorney on road vacation. In contact with attorney concerning penalties on unpaid withholding taxes.
